Terms and Conditions

Persons subscribing, whether for a free trial or by payment, ("Subscribers") to BirdGuides Ltd's Bird News Extra, Bird Text Alert, Bird News Anywhere or Email Alert services, or any combination (collectively "the Service") are deemed to accept the following terms and conditions:

1. While we endeavour to maintain a reliable service, the Service may be suspended for short periods for reasons outside of our control (e.g. technical or network failure). BirdGuides Ltd will not be liable for compensation in such an event. Should the period exceed five days, BirdGuides Ltd may, at the sole discretion of the company, offer a subscription extension as compensation.
2. Bird sightings are reported in good faith. BirdGuides Ltd cannot be held responsible for any consequences of travelling to see a reported sighting.
3. Although we undertake to broadcast information as quickly as possible, BirdGuides Ltd will not be held responsible for any delays in the sending or receipt of information.
4. BirdGuides Ltd will not be held responsible for any charges incurred for the delivery of any information from the Service.
5. Subscribers who wish to unsubscribe within 14 days of the start of their subscription will be eligible for a partial refund based on the number of messages used, in the case of Bird Text Alert, and a full refund on other news services. BirdGuides Ltd must receive written notification of your request to unsubscribe in this instance.
6. BirdGuides Ltd may terminate the Service permanently without cause or notice at any time. In this event, Subscribers will receive a pro-rata refund based on the length of time remaining on their subscription, the original price paid for the subscription and for Text Alert, the number of messages used.
7. BirdGuides Ltd cannot be held responsible for the unavailability of the Service or any consequential loss due to technical problems beyond our control, however caused.
8. The Service is tested on a variety of technical platforms, but cannot be guaranteed to work on all combinations of hardware, browser and Internet connection (and, in the case of Bird Text Alert and Bird News Anywhere, phone handset, tariff and phone operator). Refunds will only be offered as described in clause 5.
9. Subscribers may not copy or publish in any form, or forward to any third party in any form, any information obtained from the Service, without written permission from BirdGuides Ltd. Failure to comply may result in the termination of the subscription without compensation.
10. Although we will do our best to help in cases of difficulty, day-to-day maintenance of accounts (including, but not limited to: altering settings and preferences; changing passwords; updating email addresses; temporarily suspending services; updating phone numbers; use of phone handsets) is the responsibility of the Subscriber and we cannot undertake to maintain accounts on the Subscriber's behalf. 11. Email Alert: It is the Subscriber's responsibility to supply and maintain a valid email address. BirdGuides Ltd cannot be held responsible for non-receipt of information caused by failure to activate accounts, provision of an incorrect or inoperative email address, deactivation of email accounts, or other circumstances outside our control, nor do we undertake to inform Subscribers should such circumstances arise.
12. Bird Text Alert: It is the Subscriber's responsibility to supply and maintain a valid mobile phone number. BirdGuides Ltd cannot be held responsible for non-receipt of information (incoming or outgoing) caused by: failure to delete old messages, confirm phone numbers or activate accounts; provision of an incorrect or inoperative mobile phone number; deactivation of phone numbers; poor reception or signal from mobile phone network; mobile phone being switched off; credit expiries; failure to understand the features of the service or read the instructions (provided at http://www.birdguides.com/birdtextalert and linked pages therefrom); or any other circumstances outside our control, nor do we undertake to inform Subscribers should such circumstances arise.
13. BirdGuides Ltd cannot be held responsible for the accuracy or content of any external submissions to the Service.
14. Malicious submission of inaccurate or offensive material to the Service may result in the termination of your subscription without compensation.
15. BirdGuides Ltd reserves the right to publish or not to publish submitted material without notice or explanation.
16. The inclusion or mention of a birdwatching site does not imply that there is a public right to visit that site, or that visitors are welcome. Please check before visiting.
17. Messages originating from regional BirdLines may appear with a phone number from which more information may be available. Premium rate calls to BirdLine numbers are charged at 60p per minute. This is BirdGuides Ltd's way of acknowledging the contribution made by that BirdLine.
18. Subscribers undertake to abide by the Birdwatchers Code of Conduct when acting upon the information provided by the Service.
19. BirdGuides Ltd reserve the right to modify the Service without notification, though any significant changes will be announced via weekly emails to registered users and at http://www.birdguides.com/birdtextalert.
