Terms and Conditions
Persons subscribing, whether for a free trial or by payment, ("Subscribers")
to BirdGuides Ltd's Bird News Extra or Email Alert services (collectively
"the Service") are deemed to accept the following terms and
conditions:
- Bird sightings are reported in good faith. While we do our best to maintain
a reliable service, the service may be suspended for short periods for reasons
outside of our control (e.g. technical failure). BirdGuides Ltd will not
be liable for compensation in such an event. Should the period exceed five
days, BirdGuides may, at the sole discretion of the company, offer a subscription
extension as compensation.
- BirdGuides Ltd cannot be held responsible for any consequences of travelling
to see a reported sighting.
- Although we undertake to broadcast information as quickly as possible, BirdGuides
Ltd will not be held responsible for any delays in the sending or receipt
of information.
- BirdGuides Ltd will not be held responsible for any charges incurred
for the delivery of any information from the Service.
- Subscribers who unsubscribe from the Service within 14 days of the
start of their subscription will be eligible for a full refund of the
cost of their subscription, at BirdGuides Ltd's discretion.
- BirdGuides Ltd may terminate the Service permanently without cause
or notice at any time. In this event, subscribers will receive a pro-rata
refund based on the length of time remaining on their subscription and
the original price paid for the subscription.
- The Service may be suspended for short periods of up to one week without
cause or notice and at any time. BirdGuides Ltd will not pay compensation
in such an event.
- BirdGuides Ltd cannot be held responsible for the unavailability of
the Service or any consequential loss due to technical problems beyond
our control, however caused.
- The Service is tested on a variety of technical platforms, but cannot
be guaranteed to work on all combinations of hardware, browser and Internet
connection. Refunds will only be offered as described in clause 5.
- Subscribers may not copy or publish in any form, or forward to any
third party in any form, any information obtained from the Service,
without written permission from BirdGuides Ltd. Failure to comply may
result in the termination of the subscription without compensation.
- BirdGuides Ltd cannot be held responsible for the accuracy or content
of any external submissions to the Service.
- Persistent or malicious submission of inaccurate material may result
in the termination of your subscription without compensation.
- Submission of material deemed offensive will result in the termination
of your subscription without compensation.
- BirdGuides Ltd reserves the right to publish or not to publish submitted
material without notice or explanation.
- The inclusion or mention of a birdwatching site does not imply that
there is a public right to visit that site, or that visitors are welcome.
- Subscribers undertake to abide by the Birdwatchers'
Code of Conduct when acting upon the information provided by the
Service.
